Terms of Service

Welcome to Braintity. These Terms of Service (“Terms”) form a binding agreement between you and Braintity regarding your use of our website, APIs, and applications (collectively, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms.

1. Acceptance of Terms

You must be at least 16 years old to use Braintity. By accessing the Service, you represent that you have the legal capacity to enter into this agreement and that you will comply with these Terms and all applicable laws.

2. The Service

Braintity provides an AI-powered personal memory graph that transforms your reflections and notes into a structured, searchable network. The Service includes digitization funnels, retrieval-augmented AI responses, and administrative tooling to manage your data.

3. Your Account

You are responsible for maintaining the confidentiality of the email address linked to your Braintity account and for all activity that occurs under it. Notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that appear compromised or are being used in violation of these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Upload unlawful, infringing, or harmful content, including malware or content that violates the privacy or rights of others.
  • Attempt to reverse-engineer, disrupt, probe, or gain unauthorized access to the Service or its infrastructure.
  • Use the Service to harass, abuse, or generate content that exploits minors or promotes violence.
  • Submit prompt-injection payloads, scraping scripts, or automated traffic that interferes with normal operation.

5. AI-Generated Output Disclaimer

The Service uses large language models to generate summaries, reflections, and other outputs. These outputs may be inaccurate, incomplete, or unsuitable for your specific situation. Braintity is not a substitute for professional medical, legal, financial, or psychological advice. Do not rely on the Service for decisions that require expert judgment. Always consult a qualified professional for such matters.

6. Your Content

You retain all rights to the memory content you submit to Braintity. By using the Service, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing and improving the Service to you. We do not use your personal memory content to train general-purpose foundation models.

7. Credits and Paid Features

Certain features (such as AI templates and memory-node edits) consume neural credits associated with your account. Credit balances are non-transferable and carry no monetary value. Pricing, credit policies, and refund terms may be updated; any changes apply prospectively to purchases made after the update.

8. Termination

You may delete your account at any time from Settings. We may suspend or terminate access to the Service if you violate these Terms, if your account is inactive for an extended period, or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately, and your data will be handled as described in the Privacy Policy.

9. Warranty Disclaimer

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Braintity does not warrant that the Service will be uninterrupted, error-free, or secure against every possible threat.

10. Limitation of Liability

To the maximum extent permitted by law, Braintity and its affiliates, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses arising out of your use of, or inability to use, the Service.

11. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated via the Service or your registered email. Continued use of the Service after the effective date of a revision constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Braintity operates, without regard to its conflict of law principles. Any dispute will be resolved in the competent courts of that jurisdiction unless applicable law requires otherwise.
